Terms of Service & Master Subscription Agreement

Effective Date: September 14, 2026 Version 2.0 Governed by Laws of India

Welcome to School Chalen (the "Platform", "Service"), owned and operated by School Chalen Educational Technologies ("We", "Us", or "Our"). These Terms of Service ("Terms") govern the access and use of our multi-tenant mobile applications, web portals, and software APIs by subscribing educational institutions ("Schools"), school directors, administrators, teachers, staff, school bus drivers, parents, and students ("Users", "You").

1. Acceptance of Terms

By registering, downloading, logging in, or accessing School Chalen, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accepting these Terms on behalf of an educational institution, you represent and warrant that you possess full legal authority to bind that institution.

2. Description of Services & SaaS Subscriptions

School Chalen provides an automated, enterprise cloud-based educational management suite comprising:

Core School ERP: Digital student & staff attendance, automated timetables, academic marksheet generators, homework circulars, and fee invoice management.
Transit & Bus GPS Tracking: Real-time telematics, driver route monitoring, speed tracking, and automated stop arrival alerts for parents and school management.
Direct Communication & AI Tools: In-app school notices, encrypted parent-teacher WebRTC voice consultations, and AI-assisted educational query solving.

School access is provisioned on a prepaid recurring subscription model based on student capacity tiers. Services remain active as long as the subscription remains current.

3. Institutional Warranties & DPDP Act Section 9 Consent

        ⚠️ Mandatory DPDP Act 2023 Section 9 Warranty:
        Each subscribing School acts as the Data Fiduciary under India's Digital Personal Data Protection Act, 2023. The School explicitly warrants and covenants that:
        It has obtained valid, verifiable parental/lawful guardian consent under Section 9(1) of the DPDP Act 2023 prior to enrolling any minor student (under 18 years) on the Platform.
It holds legitimate educational authority (In Loco Parentis) to manage student records, emergency contact details, and transit schedules.
School Chalen operates strictly as a Data Processor carrying out institutional data instructions.

      

4. School Transit & Driver Location Terms

For school bus drivers and transit coordinators:

Drivers agree that location telemetry is transmitted in real time while an active transit run is initiated to enable child safety, route transparency, and parent ETA calculation.
Drivers agree to maintain safe driving practices and comply with all applicable motor vehicle and school transport safety regulations.
Location tracking operates via a visible Android Foreground Service (FOREGROUND_SERVICE_LOCATION) and terminates immediately upon trip completion.

5. User Accounts & Access Responsibilities

Confidentiality: Users must maintain the security and confidentiality of their authentication credentials (OTP, phone numbers, passwords). You are solely responsible for activities occurring under your account.
Role-Based Access: Access to institutional administrative consoles is restricted strictly to designated personnel approved by the subscribing School Director or Principal.
Prohibited Conduct: Users must not reverse-engineer, decompile, scrape data, inject malicious payloads, bypass multi-tenant cryptographic isolation, or transmit defamatory or harmful material.

6. Payment Processing & Fee Transactions

School Chalen facilitates online school fee collection through certified third-party payment gateways (Razorpay). School Chalen is not a bank or financial institution. Institutional fee policies, refund terms, and late fee assessments are determined solely between the parent and the respective School.

7. Multi-Tenant Data Isolation & Intellectual Property

All intellectual property rights in the Platform, brand assets, source code, neural algorithms, and visual designs remain the exclusive property of School Chalen. All institutional student records and school data remain the property of the subscribing educational institution and are cryptographically isolated by School Tenant ID.

8. Termination & Account Deletion

A School may terminate its subscription by giving written notice prior to the expiration of its billing cycle. Individual users (parents, staff, teachers) may request account and personal data deletion at any time via our public Account Deletion Request Portal.

9. Limitation of Liability

To the maximum extent permitted by applicable law, School Chalen shall not be liable for indirect, incidental, punitive, or consequential damages resulting from network connectivity failures, GPS satellite inaccuracies, or delays in push notification delivery by mobile operating systems.

10. Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. Any legal dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Gurugram / New Delhi, India.
